Terms of Service

1. Acceptance

By creating an account or using Tenby ("the Service"), you agree to these Terms. If you do not agree, do not use the Service. Tenby is operated by Tenby Inc. ("we," "us," "our").

2. The Service

Tenby is a property management platform that helps landlords manage rental properties and helps tenants interact with their landlord and unit. We provide tools for rent collection, lease management, maintenance tracking, tenant screening, compliance checking, and financial reporting.

We are not a property manager, law firm, or financial advisor. AI-generated compliance flags, lease summaries, and financial calculations are informational tools — not legal or financial advice. Always consult qualified professionals for legal, tax, and financial decisions.

3. Accounts

  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the security of your account credentials
  • One person may not maintain multiple accounts
  • Landlord accounts manage properties; tenant accounts are linked to units via invitation
  • You may delete your account at any time from Settings > Delete Account

4. Subscriptions & Pricing

Free tier: 1 unit, core features, tenant AI (lease Q&A + Know Your Rights), no credit card required.

Growth tier: $5/month ($49/year), up to 7 units, all AI features, screening, financial automation.

Scale tier: $19/month ($149/year), up to 50 units, everything in Growth plus tax package, portfolio analytics, and priority support.

Tenants never pay a subscription fee. Standard payment processing fees (Stripe) apply when paying rent.

We may change pricing with 30 days' notice. Existing subscribers are grandfathered at their current rate for the remainder of their billing period.

5. Payments

All payments are processed through Stripe. We never store payment credentials. Stripe's terms of service also apply to payment transactions. ACH processing fees (~$1.49) and card processing fees (2.9% + $0.30) are set by Stripe, not Tenby.

Tenby charges a 0.75% platform fee on rent payments, embedded in the tenant's processing fee. This fee supports platform operations.

6. Tenant Screening

Background checks are provided through Checkr and comply with the Fair Credit Reporting Act (FCRA). By ordering a screening report, you certify you have a permissible purpose under FCRA. Application fees are charged to applicants at rates compliant with state law. Adverse action notices are required and facilitated through the platform.

7. AI Features

Tenby uses AI (powered by Anthropic Claude) for lease analysis, maintenance triage, expense categorization, and compliance checking. AI outputs are informational and may contain errors. You are responsible for reviewing and acting on AI-generated content. We do not guarantee the accuracy, completeness, or legal sufficiency of AI outputs.

8. Your Data

You own your data. We do not claim ownership of your property information, lease documents, financial records, or communications. See our Privacy Policy for how we handle your information.

9. Prohibited Uses

  • Using the platform to discriminate against tenants in violation of Fair Housing laws
  • Uploading illegal content or using the platform for unlawful purposes
  • Attempting to access other users' data or circumvent security measures
  • Using automated tools to scrape or collect data from the platform
  • Misrepresenting your identity or property ownership

10. Limitation of Liability

Tenby is provided "as is." We are not liable for losses arising from reliance on AI-generated content, payment processing delays, screening report inaccuracies, or compliance recommendations. Our total liability is limited to fees you've paid in the 12 months preceding a claim. We are not responsible for landlord-tenant disputes, property damage, or legal proceedings.

11. Termination

We may suspend or terminate accounts that violate these terms. You may cancel your subscription or delete your account at any time. Upon termination, your data is handled per our Privacy Policy.

12. Changes

We may update these terms. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.
